Terms of Service

These Terms of Service ("Terms") govern your use of ziki.co.ke (the "Service"). By accessing or using the Service, you agree to these Terms.

Accounts

You are responsible for keeping your account credentials secure and for all activity under your account. You must provide accurate information and be legally able to enter into these Terms.

Your content

You retain ownership of the music and content you upload. By uploading, you confirm you have the rights to that content and grant Ziki the licence needed to host, stream, display and distribute it through the Service. You must not upload content that infringes others' rights or breaks the law.

Uploader warranties and indemnity

Each time you upload, you confirm and warrant that:

• you own, or have licensed from the owners, all the rights needed to upload, stream, sell and distribute that content on Ziki: both the sound recording (master) and the song itself (composition, lyrics and melody);
• any samples, beats, featured artists, producers and other contributors have been cleared and, where required, paid or credited;
• the content, its artwork and its title and description don't infringe anyone's copyright, trademark, privacy or other rights.

You agree to indemnify and hold harmless Ziki and its owners, staff and partners against all claims, losses, damages, fines, and costs (including reasonable legal fees) that arise from content you upload or from a breach of these warranties.

If we receive a rights claim about your content, we may remove it, hold any earnings from that content until the claim is resolved, and suspend accounts that repeatedly infringe. To report content that infringes your rights, use the Report button on the track or email support@ziki.co.ke.

Buying and selling

When you sell beats or music, you are responsible for the rights and licence terms you offer. When you buy, your use is governed by the licence the seller provides. Payments are processed by our payment provider; sales and payouts are subject to their terms and any applicable fees.

Seller commission. For sales made on or after 14 October 2026, Ziki deducts a 10% commission from each sale by a Basic account; this includes the payment processing fee, which Ziki covers. Ziki Pro accounts pay no Ziki commission; only the payment processor's fee for that sale is deducted. Your earnings balance shows the amount credited to you after these deductions. We will give notice before changing these rates.

Beat licences. Unless a listing states otherwise, a paid beat is sold under the Ziki Standard Non-Exclusive Licence, a licence agreed between the buyer and the producer. Ziki is not a party to that licence.

Acceptable use

Don't misuse the Service, including attempting to disrupt it, access it without authorisation, upload malicious code, or infringe intellectual property. We may suspend or remove accounts or content that violate these Terms.

Intellectual property

The Ziki name, brand and platform are owned by Ziki. These Terms do not grant you rights to our branding except as needed to use the Service.

Disclaimer & liability

The Service is provided "as is" without warranties of any kind. To the extent permitted by law, Ziki is not liable for indirect or consequential damages arising from your use of the Service.

Changes

We may update these Terms from time to time. Continued use of the Service after changes means you accept the updated Terms.
